Hospigrow Account Deletion Policy

Policy for Deleting User Account 

Introduction:

IMA Hub (hereinafter referred to as the “Platform” or “IMA Hub”) is an online application created and operated by Hospigrow Healthcare Technologies Private Limited (hereinafter referred to as the “Company” or “Hospigrow”). This Policy for deleting User Account (hereinafter referred to as “Policy,” or “User Account Deletion Policy”) has been created to align the working of the Platform with the existing laws and regulations, applicable to the Platform.

In this Policy, “Platform”, “IMA HUB”, “Hospigrow”, may be referred to as “we”, “us”, and “our,” and the Users and other stakeholders may be referred to as “You,” “Your,” or “User,” unless repugnant to the context).

This Policy is aligned with the following-

1. Digital Personal Data Protection (DPDP) Act, 2023;
2.  the Information Technology (IT) Act, 2000; and
3. Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.

Creation of Account:

The User may create an account on the Platform, as per the terms of use of the Platform. Every user on the Platform shall be onboarded thereon by and at the discretion of Hospigrow. The right to create an account also includes the right of the User, at its own discretion, to delete the said account from the Platform.

Deleting Account

Post creation of the said account, the User may, at its own discretion wish to delete the account from the Platform. This Policy would put in place the requisite guidelines for aiding the Users to successfully deleting the said account over the Platform without affecting any of the rights and liabilities of any Stakeholders involved.

Accordingly, for the purpose of successfully deleting his/her account, from the Platform, the User/Account holder would be required to send an email to ima@hospigrow.com, from its registered (over the Platform) email ID, which shall include the following details:

• Registered Name of the User;
• Registered Email Address of the User;
• Registered Mobile Number of the User;
• Hospital/Clinic Name of the User (if applicable);
• Express statement/request to the admin for deletion of the said account; 
• Reason for Account Deletion (Optional)

On receipt of the above mentioned email, requesting deletion of the account from the Platform, the admin would confirm and verify the authenticity of the request and proceed with further processing the same and conclude the deletion. 

Processing Period: It may take up to 30 days for your account and associated data to be permanently removed from our active systems after you initiate a deletion request.

Email Notification: We will send a confirmation email to your registered email address once the deletion is completed.

Note: No user would have the authority to suo motu delete his/her account on the Platform.

Impact on account deletion:

On successful deletion of the account by the Admin, the following would follow:

1. Permanent Removal of Personal Data: All personally identifiable information (e.g., name, email, address) will be permanently removed from our systems;
2. Permanent removal of Professional Information like Medical practice information, credentials, certification, any other qualification/s and associations;
3. Other information: Any/all information like Application preferences and settings uploaded by the user, User-generated content and records associated with the account, Notifications and communication preferences, would be deleted;
4. Loss of History and Saved Items: Any usage history, saved items, wish lists, or preferences associated with your account will be deleted.
5. Membership Benefits, Loyalty Points, or credit: You will lose access to all membership or loyalty benefits, including reward credits, and promotion linked credit to your account.
6. No Future Access: You will no longer have access to any features or services provided by the Platform.

Exception to information deletion:

Notwithstanding your request for account deletion, we may retain certain data for legitimate legal, regulatory, or security reasons, including but not limited to:

Transactional and Accounting Data: We may keep records of financial or transactional information as required for auditing or legal compliance.

Legal Obligations: We may retain data necessary to comply with any applicable laws for the time being in force, government regulations, orders from Courts, officers, or any other competent authority.

Dispute Resolution: If there are any open disputes or legal proceedings, we may retain relevant information until such matters are resolved.

All retained data remains subject to our Privacy Policy and applicable laws for the time being in force and other legal safeguards put in place in the interest of all the stakeholders.

The above data shall be retained in the form and for such period of time as per the legal requirements.

Reversing Account Deletion:

Once deleted, the User shall not have an option of overriding or reversing the said deletion of the account. You will be required to follow the entire procedure for registration and account creation afresh. The credits and other benefits which lapse on account of the deletion shall not be recoverable or transferable.

All queries, questions, concerns, assistance requirement, pertaining to deleting your account, shall be emailed to ima@hospigrow.com. We shall make all the best endeavors to reply/respond to the said emails within 72 Hours of receipt of the said email.

Amendment to this Policy:

We reserve the right to modify or update this Account Deletion Policy from time to time, at our own discretion and/or subject to applicable rules, regulation and law/s for the time being in force. Any changes will be published on our website and/or Platform and will take effect upon posting. We encourage you to review this Policy periodically to stay informed about how we handle account deletions.

Governing Law and Jurisdiction

This Policy is governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from or relating to this Policy shall be subject to the exclusive jurisdiction of the courts in the territory where the Company is registered.

By proceeding with the account deletion process, you acknowledge that you have read, understood, and agreed to the terms outlined in this Policy.
